REGULAR MEETING
TUESDAY, SEPTEMBER 16, 2014
MEMORIAL TOWN HALL, 52 LYME STREET
OLD LYME, CT - 7:30 P.M.

Present and voting were Judy McQuade, Chairman, Art Sibley, Vice Chairman, Kip Kotzan, regular member, Karen Conniff, regular member and Harry Plaut, alternate

Present:  Keith Rosenfeld, Land Use Coordinator

Absent:  Mary Stone, Secretary and Nancy Hutchinson, alternate

Case 14-19 – Scott & Kathleen Boulanger, 73 Portland Avenue

A Motion was made by K. Kotzan, seconded by A. Sibley to CONTINUE the public hearing on 73 Portland Avenue to the OCTOBER 21, 2014 Regular Meeting. No discussion and a vote was taken:  In favor:  A. Sibley, J. McQuade, K. Kotzan, K. Conniff    In opposition:  Abstaining:  None   The motion passed unanimously. 4-0-0  [H. Plaut recused himself]

Case 14-20 – Jeremiah J. Grady, 40 Billow Road

A Motion was made by K. Kotzan, seconded by A. Sibley to GRANT the necessary variances to build as per plans submitted.  Discussion:  J. McQuade stated that there is not a problem with the rear setback, the applicant can compromise to satisfy the side setback. A. Sibley stated that sufficient hardship had not been shown.  K. Kotzan felt some compromises could be made for a “reasonable use”, i.e. garage.  Also proposal is maximally offensive to the regulations with size and location of the garage.  No further discussion and a vote was taken:  In favor:  None   Opposed:  A. Sibley, J. McQuade, K. Kotzan, K. Conniff, H. Plaut  Abstaining:  None   The motion failed to pass.  The variances are DENIED.

Case 14-21 – Town of Old Lyme, 166 Boston Post Road (Hains Park)

A Motion was made by A. Sibley, seconded by H. Plaut to GRANT the necessary variances to allow this technicality to be removed and the project to move along.  No discussion and a vote was taken:  In favor:  A. Sibley, J. McQuade, K. Kotzan, K. Conniff, H. Plaut  In opposition:  Abstaining:  None   The motion passed unanimously. 5-0-0

Reasons to Grant:  No substantial change to the original variances granted.

Case 14-22 – Jennifer & Edward Reyes, 29 Massachusetts Road

A Motion was made by A. Sibley, seconded by K. Kotzan to GRANT w/condition the necessary variances for this building that has been put in without a permit but which is a very agreeable improvement to the property.  The condition is that the building will never be converted into additional sleeping area and that it will not accommodate a vehicle. The structure would be for storage and for the enjoyment of having a little more room for the necessary things that they have there.  No discussion and a vote was taken:  In favor:  A. Sibley, J. McQuade, K. Kotzan, K. Conniff, H. Plaut  In opposition:  Abstaining:  None   The motion passed unanimously. 5-0-0

Minutes

A Motion was made by K. Kotzan, seconded by H. Plaut to APPROVE the Minutes of the June 17, 2014 Regular Meeting, as submitted.  No discussion and a vote was taken:  In favor:  A. Sibley, J. McQuade, K. Kotzan, K. Conniff, H. Plaut  In opposition:  Abstaining:  None   The motion passed unanimously. 5-0-0

A Motion was made by K. Kotzan, seconded by H. Plaut to APPROVE the Minutes of the July 15, 2014 Regular Meeting, with the following correction: page 3 under Case 14-17, paragraph 4 where it states “. . .because the legal ad had been placed already they revised the drawing to show a little cut out in the building which is 4’ x 10’ ”, it should read “4’ x 14’ ” .  No discussion and a vote was taken:  In favor:  A. Sibley, J. McQuade, K. Kotzan, H. Plaut  In opposition:  Abstaining:  K. Conniff,    The motion passed. 4-0-1

Adjournment

A Motion was made by A. Sibley, seconded by K. Kotzan to adjourn the September 16, 2014 Regular Meeting; no discussion and a vote was taken.  The motion to adjourn passed unanimously.  5-0-0    The meeting adjourned at 9:05 p.m.

at 7:30 p.m. at the Town Hall.  The ZBA does not meet in August
